The following Terms & Conditions govern your use of the website and services provided by Lazer Photos & Cameras (“we”, “us”, “our”). By accessing or purchasing from our website or in-store, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our website or services. These Terms are governed by the laws of New Zealand.

Use of our website

All content on this website, including text, product descriptions, images, logos, graphics, and design elements, is the property of Lazer Photos & Cameras or its content suppliers and is protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, distribute, modify, or commercially exploit any content from this website without prior written permission from Lazer Photos & Cameras.

You agree not to:

• Use the website for unlawful purposes;
• Attempt to gain unauthorised access to our systems;
• Interfere with the operation or security of the website;
• Use automated tools (such as bots or scraping tools) to extract website data.

We reserve the right to restrict or terminate access to the website for users who breach these terms.

Errors & omissions

We endeavour to keep all information on our website, social media channels, and in-store materials accurate and up to date; however, errors or omissions may occasionally occur.

This may include, but is not limited to:

• Pricing errors;
• Promotional details;
• Product descriptions;
• Stock availability;
• Shipping fees;
• Delivery timeframes.

We reserve the right to correct any such errors and update information at any time without notice. We are also not responsible for inaccurate information provided by third-party services such as search engines or price comparison websites. Product images are indicative only and may not be to scale.

Placing orders

Payment

All prices are listed in New Zealand Dollars (NZD) and include 15% GST, unless otherwise stated. Pricing is subject to change without notice.

We accept the following payments:

• In-store payment (for "click & collect" orders only);
• Gift cards;
• Bank transfer;
• Credit card payment.

Online card payments are processed through Stripe. Payment must be received in full and verified before an order can be shipped, ordered from a supplier (for special order items), or collected. Credit card processing fees may apply.

Gift cards

We offer gift cards for purchase both in-store and online. The following terms apply to gift cards issued by Lazer Photos & Cameras:

• Gift cards can be used across multiple purchases until the card's value has been fully redeemed;
• Gift cards can be used in conjunction with other payment methods if the purchase total exceeds the remaining value of the gift card;
• Only one gift card can be applied per order;
• Promotional or discount codes cannot be used when purchasing a gift card;
• Gift cards are non-refundable and cannot be redeemed for cash;
• Gift cards cannot be reloaded once the value has been fully used;
• Gift cards cannot be used to purchase more gift cards, nor can they be exchanged or consolidated into new gift cards;
• Physical gift cards hold no value until activated at checkout;
• We are not responsible for lost, stolen, or damaged gift cards;
• We are not required to honour gift cards once the expiry date has passed.

Order verification

To help prevent fraudulent or unauthorised transactions, we reserve the right to verify any order before accepting, processing, or dispatching it.

Verification may include, but is not limited to:

• requesting additional identification from you;
• confirming your payment details;
• contacting you to verify order information; or
• requesting an alternative payment method.

If we are unable to verify the details of an order, we reserve the right to cancel or refuse the order. In such cases, any payment received will be refunded using the original payment method. Additionally, we reserve the right to limit or refuse orders where multiple orders are placed using the same payment method, email address, customer account, IP address, or delivery address and, in our reasonable opinion, the activity indicates potential fraud or an attempt to circumvent our policies.

Orders suspected of fraud, unauthorised payment use, or suspicious activity may be declined without notice.

Click & collect orders

When collecting a click & collect order from our store, we reserve the right to ask for identification. If another person is to collect the order on your behalf, you must inform us. We reserve the right to refuse to hand over a click & collect order if we cannot ascertain the identity of the person collecting the order.

Special orders

For special order items:

• Full payment or a deposit may be required before the order is placed;
• Cancelled special orders may be subject to a minimum 20% restocking fee to cover supplier & handling costs;
• Lead times vary depending on supplier availability and shipping conditions. Estimated timeframes will be provided after the order is placed;
• Extended delays may occur during holiday periods such as Christmas and New Year, when supplier warehouses may be closed.
• To the extent permitted by New Zealand law, we are not liable for any losses incurred due to supplier delays or inability to supply a special order item.

Product availability & discontinuation

All products listed on our website are subject to availability. In some cases, products may become unavailable or discontinued by the manufacturer or supplier without notice.

If we are unable to supply a product you have ordered, we will contact you to offer an alternative product, provide an updated delivery timeframe, or issue a full refund.

Manufacturer warranties

Some products sold by Lazer Photos & Cameras are covered by manufacturer warranties. Where applicable, warranty claims may need to be handled directly with the manufacturer or their authorised service agents. This does not affect your rights under the Consumer Guarantees Act 1993.

Shipping & delivery

The following conditions apply to orders shipped by us:

• Orders are typically processed within 2–3 business days if the item is in stock.
• Special order and made-to-order items may have longer lead times;
• Orders are not dispatched on weekends or public holidays;
• Delivery timeframes are estimates only, and may be affected by courier delays, public holidays, or adverse weather;
• You must provide us with valid physical New Zealand delivery address;
• We do not deliver to P.O. Box addresses.
• We do not ship outside New Zealand.
• Rural delivery addresses will incur an additional Rural Delivery (RD) surcharge;
• Orders to offshore island addresses may incur additional shipping fees. Please contact us prior to ordering if your address is on an offshore island (e.g. Waiheke Island, Great Barrier Island, Chatham Islands, or Stewart Island/Rakiura);
• You must select the correct shipping option at checkout. If the incorrect shipping option is selected, we may withhold dispatch or cancel the order until the correct shipping fee is paid.

Once an order has been dispatched or collected by the courier, we cannot amend delivery details or the order. Ownership and risk in goods passes to the customer once the goods have been delivered to the address provided at checkout, subject to your rights under the Consumer Guarantees Act 1993.

Free Urban Shipping Offer

Orders over $800 qualify for free shipping to urban addresses only, subject to the following conditions:

• Rural addresses will still incur the $12 RD surcharge;
• Offshore island (e.g. Waiheke Island, Great Barrier Island, Chatham Islands, or Stewart Island/Rakiura) addresses are excluded;
• Oversized items (including but not limited to telescopes and tripods) are excluded;
• Orders with a total weight exceeding 10kg are excluded.

Lazer Photos & Cameras reserves the right to modify or withdraw this offer at any time.

School photo orders

Orders for school photos can be placed online (via our website) or with the envelopes distributed by the school prior to school photo day. When ordering school photos:

• A separate order form must be completed for each student;
• Ensure you have correctly filled out all required fields on the order form;
  • If you are unsure of any details (e.g. what class your child is in), please confirm them with the school prior to the order deadline.
  • We are not responsible for any incorrect orders if you have omitted or incorrectly entered any required fields on the order form.
  • If you realise you have made an error on the order form, please contact our team as soon as possible.
• Include the exact cash amount for your order (if you are ordering with an envelope and are paying with cash).
  • Orders that have not been paid for in full by the deadline for will be cancelled.
• Orders for class photos only may be placed at any time;
• Orders for student or sibling portraits must be placed before the deadline listed on the relevant school page;
  • It is your responsibility to check the order deadlines for your child's school.
  • Children & adults that do not attend or work at the school cannot be included in portraits.
  • No exemptions are made for late portrait orders as we need to finalise student portrait schedules prior to school photo day.
• If a student is absent on photo day (for example due to illness), please contact us and we will either:
  • Arrange a rescheduled photoshoot at our store, or
  • Provide a refund.
• School photo orders typically take 3–4 weeks to complete following photo day. This timeframe may vary depending on:
  • School size;
  • School approval processes;
  • School holidays;
  • Other scheduled photography work.

Completed orders placed before photo day are normally returned to the school for distribution. If you have not received your order, please first check with the school before contacting us.

Passport & ID photos

The following terms apply to passport & ID photos taken by us.

Your responsibilities

• Inform the staff member taking your photo of the exact document you are applying for (e.g. passport, visa, driver licence), including the issuing country;
• Specify whether you require printed photos, a digital file, or both;
• Follow all instructions provided by the staff member to ensure the image meets official requirements (including pose, expression, and appearance guidelines).

To the extent permitted by New Zealand law, we take no responsibility for photos that do not meet application requirements if you fail to provide accurate information or follow staff instructions.

Acceptance

We will take all reasonable care to ensure your ID photo meets the official requirements for the document specified at the time of capture. However, acceptance of ID photos is at the sole discretion of the issuing authority, including any automated or biometric assessment processes used by the issuing authority, and requirements may change without notice. If your photo is rejected by the relevant authority due to a fault attributable to us, we will either:

• Offer a free retake; or
• Provide a full refund of the ID photo cost.

• Incorrect or incomplete information was provided by the customer;
• The customer did not follow the instructions of the staff;
• The customer modified (digitally or physically) the ID photo after delivery.

Due to the nature of photographing infants and young children, we do not guarantee that a compliant image can be captured in a single session.

Printing services

The following terms apply when submitting images, film, or digital files for printing, processing, or reproduction.

Image quality & file size

You are responsible for ensuring that any images, documents, or digital files supplied to Lazer Photos & Cameras are of suitable quality and resolution for the intended print size or product.

Image quality may be affected by factors including (but not limited to):

• Low image resolution;
• Excessive cropping;
• Compression artifacts;
• Motion blur;
• Poor focus;
• Screenshots or images downloaded from social media or messaging platforms.

While we may provide general guidance where possible, we do not inspect every file for image quality prior to printing and are not responsible for prints that appear blurry, pixelated, grainy, distorted, incorrectly cropped, or otherwise unsatisfactory due to the quality or resolution of the files supplied by the customer.

Customers are responsible for reviewing uploaded images and ensuring they are suitable for printing before submitting an order. As a general guide, we recommend that images have a resolution equivalent to at least 300 DPI at the intended print size for best results.

Please note that printed products may be cropped slightly to fit the target print size or aspect ratio.

Copyrighted images

By submitting images, film, or digital files to Lazer Photos & Cameras for printing, processing, or reproduction, you confirm that:

• You are the copyright owner of the images; or
• You have obtained permission from the copyright holder to reproduce the images.

To the extent permitted by New Zealand law, we accept no responsibility for copyright infringement arising from materials supplied by customers. We reserve the right to refuse to print or reproduce any images that we reasonably believe may infringe copyright or contain unlawful, offensive, or inappropriate content. You agree to indemnify Lazer Photos & Cameras against any claims, damages, or costs resulting from the reproduction of images supplied by you.

Photography Courses

Enrolment

Your enrolment in our photography courses is confirmed once full payment of the course fee has been received by us. Payment must be made seven (7) days prior to the course start date unless otherwise arranged.

Sessions

Session locations will be advised prior to each session via email. Sessions may be rescheduled or cancelled at our discretion due to adverse weather, tutor illness or other factors beyond our control.

If you are unable to attend a session, please contact us. We may provide course materials where possible, however missed sessions are not refundable or transferable.

Equipment

You are required to bring your own camera to the course. We recommend either a DSLR or mirrorless camera. You are responsible for the care and security of your equipment at all times. We are not responsible for any loss or damage to your equipment.

Conduct

All participants must follow instructions given by the tutor and behave respectfully towards other attendees and their property. We reserve the right to remove any participant who is disruptive, unsafe, or abusive. No refunds will be provided in these cases.

Cancellation, transfer & refunds

You may cancel or transfer your enrolment up to seven (7) days prior to the course start date. Cancellations made within seven (7) days of the start date are non-refundable.

If a course is cancelled by us (for example due to low enrolment or unforeseen circumstances), you may choose to receive a full refund or transfer to another course date.

If you transfer to another course and the course fee is higher, you may need to pay the difference. This difference must be paid at least seven (7) days prior to the start date of the course you transferred to.

Event photography

We will make reasonable efforts to capture key moments and provide coverage of the event as agreed. However, we do not guarantee that every individual, group, or moment will be photographed.

Both photography and/or videography may take place throughout the event. This may include posed images taken in designated portrait areas as well as candid images captured around the venue. Image results may be affected by factors outside our control, including lighting, weather, venue restrictions, and the behaviour of attendees.

We will deliver images within a reasonable timeframe following the event, usually within 3 business days. Delivery times may vary depending on the size and nature of the event. Unless otherwise agreed, we may use images captured at events for promotional purposes, including on our website and social media.

If any attendee does not wish to be photographed, they should inform our photographers at the event. Requests for image removal may be made by contacting us at info@lazerphoto.co.nz, and we will respond to reasonable requests as soon as practicable. Requests should include the event name & date, and the filename(s) of the image(s).

School balls & events

By booking us for a school ball, prizegiving, or other school event, the School confirms that it has obtained all necessary permissions and consents from students and, where required, their parents or guardians, for photography and/or videography to take place at the event.

The School acknowledges that images may be made available in an online gallery and may be used by us for reasonable promotional and marketing purposes, including on our website and social media, unless otherwise agreed in writing.

The School agrees to notify us prior to the event of any students who must not be photographed or whose images must not be published, and to provide sufficient identifying information to enable us to comply. We will make reasonable efforts to comply with any notified restrictions.

Photobooth hire

Operation & hire

The photobooth and all associated equipment remain the property of Lazer Photos & Cameras at all times. Users must follow any instructions provided.

We will make all reasonable efforts to ensure operation of the photobooth during the hire period. However, we are not responsible for any interruptions caused by power outages, venue restrictions, misuse by users, or others factors outside our control. Additionally, we are not responsible for printing delays, print quality issues, or missed images caused by user error or technical issues outside our control.

The hirer is responsible for ensuring there is adequate space and access to power, and suitable conditions for setup and operation of the photobooth.

Damage and loss

The hirer is responsible for any loss of or damage to the photobooth or equipment caused by misuse, neglect, or intentional damage by guests. We reserve the right to stop operation of the photobooth if we suspect the equipment is being misused or damaged, or if conditions become unsafe.

Photography copyright & licensing

Unless otherwise agreed in writing, Lazer Photos & Cameras retains the copyright in all photographs and video recordings captured by us. We grant a non-exclusive licence to use the delivered images for the purpose for which they were commissioned. Images must not be sold, sublicensed, or otherwise commercially exploited by third parties without our prior written consent.

Returns & refunds

Please ensure you are ordering the correct item(s) before completing your purchase. Once an order has been dispatched or collected by the courier, it cannot be changed or cancelled.

We are not obligated to accept returns due to you changing your mind. This does not affect your rights under the Consumer Guarantees Act 1993. If we agree to accept a change-of-mind return:

• Shipping costs will not be refunded;
• The buyer must return the item within 7 days of delivery;
• Return shipping is the buyer’s responsibility;
• Items must be returned unused, undamaged, and in original packaging with all materials included.

Faulty and damaged products

If your product arrives faulty or damaged, please notify us as soon as reasonably possible (we recommend within 24 hours of delivery) by emailing info@lazerphoto.co.nz with your order number and a description of the fault or damage.

Please retain all packaging materials. We may request photos of:

• Packaging;
• Shipping materials;
• The damaged item(s).

Consumer Guarantees Act 1993

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA).

If you believe a product supplied by us is faulty or does not meet the guarantees required under the CGA, please contact us.

Uncollected jobs

Due to limited storage space, you must collect your completed jobs promptly. We will attempt to contact you using the details provided once your job is ready.

If we cannot contact you or the job remains uncollected:

• All jobs except film processing:
  • May be disposed of one year after completion.
• Film processing jobs:
  • Negatives and prints may be disposed of one month after completion.
  • If you have instructed us not to return film negatives, they will be disposed of immediately after processing.

Product reviews & Q+A

Website visitors may post written reviews and questions for the products we list on our website. Reviews are collected and published by HelpfulCrowd in accordance to their privacy policy. Lazer Photos & Cameras reserves the right to remove reviews that contains content that is (but not limited to):

• Explicit;
• Illegal;
• Copyright-infringing;
• Threatening;
• Defamatory, or
• Spam.

This right does not constitute an obligation. By submitting a review, you grant us permission to publish your name and review. To the extent permitted by New Zealand law, we do not take any responsibility and assume no liability for any content published by you or a third party.

Website & blog content disclaimer

The information, articles, buying guides, reviews, tutorials, and other content published on our website are provided for general informational purposes only. While we take reasonable care to ensure our content is accurate and current at the time of publication, product specifications, pricing, availability, technology, and industry information may change without notice.

We may feature or recommend products that we stock and sell. Any opinions or recommendations published on our website reflect our team's knowledge and experience and are intended to help customers make informed purchasing decisions. Limitation of liability

To the maximum extent permitted by New Zealand law, Lazer Photos & Cameras will not be liable for any indirect, incidental, or consequential loss or damage arising from:

• The use of our website;
• Delays in delivery;
• Product availability issues;
• Participation in photography courses, including any injury, loss, or damage occurring during sessions;
• Third-party courier services.

Subject to your rights under the Consumer Guarantees Act 1993, our total liability for any claim relating to goods or services supplied by us is limited to the amount paid for those goods or services.

Nothing in these Terms limits or excludes your rights under the CGA or other applicable New Zealand consumer laws.
